A declaration of conformity (including a declaration of conformity) in Ukraine is a report, opinion, certificate, certificate (including a type examination certificate or a certificate of conformity) or any other document confirming the fulfillment of the specified requirements regarding the object of conformity assessment.
Conformity assessment - issuance of a document of compliance, which is based on a decision taken after a critical review that the fulfillment of specified requirements has been proven.
Declaration of Conformity is a mandatory document if safety requirements and compliance with technical regulations are applied to the product.
Declaration of conformity (declaration of conformity) in Ukraine is not a primary document and is drawn up on the basis of a certificate of conformity or test reports.
Since one product can be subject to several technical regulations at the same time, there can be several declarations of conformity for one product. Now it is allowed to draw up one declaration indicating all the regulations. It is worth noting that not every product has a technical regulation and that is why it is impossible to obtain a declaration of conformity with technical regulations. In this case, it is necessary to obtain a voluntary certificate of conformity, since there are no technical regulations that define the safety requirements for this product.
The Certificate of Conformity (Type Examination Certificate) and the declaration of conformity with the technical regulations have the same legal force regarding the confirmation of product quality and safety. However, it is worth noting that according to Article 28 of the Law of Ukraine "On Technical Regulations and Conformity Assessment"..
The declaration of conformity is drawn up in accordance with the requirements for its content, approximate structure or form, established by the relevant technical regulations.
And this means that one of the points of the declaration must contain and / or numbers of test reports, the number of the type examination certificate issued by the certification body in Ukraine.
Thus, to draw up a declaration, you need a basis (document) confirming the content of the Declaration.
As a rule, to participate in a tender or deliveries to large networks, they do not require a Declaration, but a Type Examination Certificate, or both.
That is, to confirm the conformity of their products with the technical regulations, it is enough for an importer or manufacturer to provide a Declaration of Conformity (drawn up by the importer or manufacturer in the appropriate form and is a document drawn up under his personal responsibility), however, the Declaration must be drawn up on the basis of test reports or a Certificate of Conformity (Type Examination Certificate).
Regarding the Declaration of Conformity, we want to highlight some points
If a certain type of product is subject to several technical regulations that require a declaration of conformity, a single declaration of conformity must be drawn up for all such technical regulations, if it is provided for by the relevant technical regulations. Such a declaration of conformity must include the relevant technical regulations , including information about their official publication.
A single declaration of conformity may take the form of a dossier consisting of the respective individual declarations of conformity.
In cases and in accordance with the requirements specified in certain technical regulations, products, upon entering the market or putting into operation (operation), must be accompanied by a declaration of conformity, its copy or a simplified declaration of conformity.
The declaration of conformity must be drawn up in the state language, and if it was drawn up in another language, it must be translated into the state language.
If the technical regulation requires product support when placing on the market or putting into operation (operation) a declaration of conformity, its copy or a simplified declaration of conformity, such a declaration must be drawn up or translated in accordance with the requirements of the law on the procedure for the use of languages.
Special technical regulations may establish requirements for additional use in the declaration of conformity or its copies in other languages.
